Media Shed Ltd and The Property Chronicle (TPC) are committed to complying with the General Data Protection Regulation and the Data Protection Act 2018. We take the processing and looking after the personal information you share with us very seriously. We want you to be confident that your personal data is kept safely and securely and to understand how we use it to offer you a good experience.

We have published this notice to help you understand:

– how and why Media Shed collects information from you;
– who we share your information with, why and on what basis, and
– what your rights are.

If we make changes to this notice we will notify you by updating it on our website. Under the GDPR regulations Media Shed will become what is known as the ‘Data Controller’ of the personal data you provide to us, and we will sometimes refer to ourselves in this notice as “we” or “us”. By Data Controller, this means Media Shed determines the purposes and way in which any personal data are, or will be, processed.

What information do we collect when you order from us and why?

When you buy or download free products from us, you are entering into a contract with us. To order from us you will need to provide personal information such as;

– full name
– address
– contact numbers, and
– email address.

When you pay for your order using a credit or debit card we do not store this data ourselves but this is passed securely to our payment services provider who will use the details to process the payment and who will store the card details securely and in compliance with all data security regulations.

To undertake website personalisation, we will also gather information about the devices you use to access our sites (desktop and mobile), and this may include IP address. For further information on our use of cookies and tracking please see our Cookie Notice.

How do we use your information?

The Data Protection regulations say that we are allowed to use and share your personal data only where we have a proper reason to do so. The law says we must have one or more of these reasons and these are:
– Contract – your personal information is processed in order to fulfill a contractual arrangement e.g. to send you your magazine order.
– Consent – where you agree to us using your information in this way e.g. for us contacting you if you agreed for us to do so
– Legitimate Interests – this means the valid lawful basis upon which TPC is able to send its Weekly newsletter to recipients is GDPR article 5 “legitimate interest”; to allow us to provide you with the best products and services in the most secure and appropriate way e.g. to transfer your data to certain Third Parties such as partners.

1. TPC only uses people’s work / professional e-mails that it has obtained lawfully:
(a) proportionately:
– we only use the work e-mail, already in the public domain, of those who are actively involved in investing and/or study of Real estate, Real assets, Alternatives;
– the people we send e-mails to are either recommended to us and/or referred to us and/or who we know to be active in areas covered by TPC;
– we send people our newsletter that contains articles that are relevant and/ or will help them with their work and /or studies;
– the newsletter we send is highly endorsed by leaders in the industry and academia;
– no third parties have any access to the TPC database;
– it is made very clear in every TPC communication that the recipient can opt-out and/ or complain;
– it is made very easy for any recipient to opt out;
– once opted out no recipient is contacted again;
– TPC newsletters can cause no financial and/or any other harm and/or distress to recipients;

(b) has minimal privacy impact:
– we store only the work e-mail of those actively involved in areas covered by TPC;
– we do not store any other information for anyone, eg financial and/or private;
– on every e-mail we send we offer a prominent option to opt out;
– we make it very easy to opt out;
– we never contact anyone who has opted out;
– we do not store any information of someone who has opted out;
– it is made very clear and obvious that the recipient can opt-out and/ or complain;
– we distribute all communications via Mailchimp which oversees and monitors the statistics (e.g. opt-outs, bounces, complaints) from the recipients;
– we do not share e-mail information of TPC recipients with any third party;

(c) people would not be surprised or likely to object:
– the TPC newsletter is very relevant and targeted to the professional and/or academic interests of the recipient;
– TPC contains relevant articles by leading academics, investors, and operators in Real estate, Real assets, and alternatives;
– only sent to the professional e-mails of those who have professional and/ or academic involvement with Real estate, Real assets, alternative investing;
– many of the writers will be known to the recipients;
– the TPC newsletter is acknowledged to be a service that can help investors and operators to understand better the asset classes they operate within.

2. TPC believes it is in the “legitimate interest” of the recipients to receive our newsletter:
– relevant and targeted to those that have professional and/or academic interest in Real estate and alternatives
– receive for free TPC the valuable analysis/articles/research from our contributors;
– the newsletter is endorsed by some of the leading operators/thinkers in the business;
– it is very easy to opt out from all TPC assets and this option is always prominently offered to recipients;

3. Under Recital 47 of GDPR: it is in the “legitimate interest” of TPC to contact the recipients:
– to introduce and direct market TPC to a targeted global audience of those who are involved in the profession and/or study of Real estate, Real assets, and Alternatives;
– to demonstrate to the industry leaders and/or those studying in the areas TPC covers the scope and range of TPC coverage via direct marketing;
– there is no other alternative method for TPC to introduce its articles, contributors, and coverage to a wide audience of those that will benefit from reading and having access to TPC free articles;

4. There is a wider public interest in making TPC articles, by leading academics operators and investors, available for free:
– helps those who will find them useful for their work and/or studying in Real estate and alternatives investing;
– helps promote social mobility philanthropic initiatives to the wider industry (e.g. The Academy of Real Assets);

5. TPC has adopted the ICO checklist for testing legitimate interest – see below (https://www.cookieyes.com/blog/legitimate-interest/)

6. TPC follows the best business-to-business publishing industry practice;
– before sending TPC Weekly to anyone we send an introductory e-mail that we have a legitimate belief that TPC will be of use and interest to them and at no cost;
–  at every stage, we make clear, and offer, a very clear and easy opt-out;
– very clear complaints process offered;
– no sensitive, financial information or data of recipients held by TPC;

7. Evidence that our policies are appropriate and compliant with GDPR:
– a steady stream of people do opt out but significantly lower opt-out percentage than industry average;
– opt-outs are never re-contacted and information no longer stored;
– newsletter is a valuable resource with pieces by the leading thinkers in the industry;
– very high levels of engagement (e.g. opens of the newsletter and/or clicks through to read the articles) demonstrate value/interest to audience;
– tiny levels of abuse complaints (significantly lower than industry average);

8. Further protection of recipients and compliance via TPC use of Mailchimp to distribute its newsletter:
– Mailchimp is a further safety net for the ICO and monitors every week the statistics of all those that TPC distributes to (i.e. bounces, opt-outs, complaints);
– Since TPC’s Launch in 2017 Mailchimp has never contacted TPC re its newsletter distribution;

9. TPC publisher (LP2limited) is member of the ICO and regularly reviews its processes and practice to ensure sure continuing compliance;

10. TPC has industry approved and standard data protection, privacy and GDPR policies that are available for everyone to see;

11. TPC digital publications are the lowest of risk for recipients:
– content only sent to recipients that have a legitimate interest in receiving it;
– content only sent to recipients who have been referred/recommended and/ or sourced as operators, investors, academics in the areas covered by TPC;
– very obvious and clear signposting to allow unsubscribe;
– absolute TPC policy of not sending anything to anyone again once they have opted out;
– In 30+ years of legal practice in this field our lawyer has never come across an ICO investigation/ inquiry of a legitimate publisher acting  in a similar way to TPC;
– TPC contract publisher (Media Shed) have never been in receipt of any ICO letter or abuse inquiry for any publication they are responsible for.

Summary:

We believe that TPC distribution of its Weekly is covered by the article 5 exemption as it has a legitimate interest in contacting those involved in the industries, investment asset classes covered by TPC. The Weekly is not a sales vehicle but a service offering for free the best analysis and content. The following demonstrates that TPC is justified in its approach and is very powerful evidence that the “legitimate interest”exemption applies:
– high levels of engagement with the newsletter;
– extremely low levels of opt-outs;
– minuscule abuse complaints;
– compliance with Mailchimp requirements.

In addition, TPC is a member of The ICO and has a published GDPR and LIA policy.

– Legal Obligation – where there is statutory or other legal requirement to share the information e.g. when we have to share your information for law enforcement purposes.

Who we share your information with and why

Media Shed works with a number of trusted suppliers in order to provide you a high quality service.

Some examples of the categories of third parties with whom we share your data are:

Delivery Partners:

In order for you to receive your goods, Media Shed works distributors firm such as Royal Mail and they use a number of delivery. We only pass them the relevant information required in order to ensure delivery of your order.

IT Companies:

Media Shed works with businesses who support our website and other business systems.

Marketing Companies:

We work with marketing companies who help us manage our electronic communications with you or carry out surveys and product reviews on our behalf.

Payment processing:

Media Shed works with trusted third party payment processing providers in order to securely take and manage payments.

Keeping in touch with you

We want to keep you up to date with information about new products and special offers. When you place an order with us, or download a free ebook, we will ask you if you want to receive this type of marketing information.

In addition we will ask you whether you would like to be contacted by us with offers from carefully selected third-party firms.

Media Shed will not share your information with any third party companies.

If you decide you do not want to receive this marketing information you can opt out using the unsubscribe link in any of any of the emails you receive or request that we stop by writing to the Data Protection Officer at the address provided above, emailing contact@propertychronicle.com.

You may continue to receive mailings for a short period while your request is dealt with.

How long we keep your information

If we collect your personal information, the length of time we retain it is determined by a number of factors including the purpose for which we use that information and our obligations under other laws.

We may need your personal information to establish, bring or defend legal claims. For this purpose, we will always retain your personal information for 7 years after the date it is no longer needed by us for any of the purposes listed under How we use your information above. The only exceptions to this are where:
– the law requires us to hold your personal information for a longer period, or delete it sooner;
– you exercise your right to have the information erased (where it applies) and we do not need to hold it in connection with any of the reasons permitted or required under the law;
– we bring or defend a legal claim or other proceedings during the period we retain your personal information, in which case we will retain your personal information until those proceedings have concluded and no further appeals are possible; or
– in limited cases, existing or future law or a court or regulator requires us to keep your personal information for a longer or shorter period.

What are your rights?

– Right of access –to request access to your personal information and information about how we process it
– Right to rectification –to have your personal information corrected if it is inaccurate and to have incomplete personal information completed
